Terms of Service

1. The Service

prospiq is a B2B email and phone enrichment platform. You provide a person's name and company, and we attempt to find their verified work email address and/or phone number using a combination of proprietary algorithms and third-party data sources.

We provide enrichment results on a best-effort basis. While we strive for accuracy, we do not guarantee that every result is correct, current, or complete. Contact information changes frequently, and results should be verified before use in critical communications.

2. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must provide accurate information when creating your account. You may not create an account using a disposable email address or impersonate another person or organization.

We reserve the right to suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.

3. Credits and Billing

The Service operates on a credit-based system. Credits are consumed when enrichment results are found:

• Email enrichment: 1 credit per verified email found
• Phone enrichment: 10 credits per phone number found
• Combined search: up to 11 credits (1 for email + 10 for phone)
• No credits charged if no results are found
• Repeat searches for the same contact by the same user are free

New accounts receive a limited number of free credits. Additional credits can be purchased through monthly or annual subscription plans. Pricing is displayed on our pricing page and may change with 30 days' notice.

Payments are processed by our third-party payment providers. Customers in India are served by Razorpay. We use LemonSqueezy as our merchant of record for international payments, which we are rolling out on a phased basis. By purchasing credits or subscriptions, you agree to the applicable provider's terms.

4. Acceptable Use

You agree to use the Service only for lawful B2B prospecting purposes. You must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. Key restrictions include:

• Do not use results for spam, unsolicited bulk email, or any communication that violates anti-spam laws (CAN-SPAM, GDPR, DPDP Act)
• Do not use the Service to harass, stalk, or harm individuals
• Do not resell, redistribute, or sublicense enrichment data
• Do not attempt to scrape, reverse-engineer, or abuse the Service or its APIs
• Do not use automated tools to circumvent rate limits or credit controls

5. Data Ownership and Licenses

You retain ownership of any data you input into the Service (names, companies, CSV uploads). We retain ownership of the enrichment results, domain intelligence, and any data generated by the Service.

We grant you a limited, non-exclusive, non-transferable license to use enrichment results for your own B2B prospecting purposes. You may not resell this data or use it to build a competing service.

6. Intellectual Property

The Service, including its code, design, algorithms, brand, and documentation, is the intellectual property of Pathweavers LLP. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that enrichment results will be accurate or current.

We are not responsible for how you use the contact information obtained through the Service. You are solely responsible for ensuring your outreach complies with applicable laws.

8. Limitation of Liability

To the maximum extent permitted by law, Pathweavers LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, lost data, or business interruption.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

You may close your account at any time by contacting us at support@prospiq.net. We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or fail to pay for subscriptions.

Upon termination, your right to use the Service ceases immediately. Unused credits are non-refundable unless otherwise required by law. We may retain your data as described in our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Service or sending you an email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
